GUIDELINES ON REQUIREMENTS FOR NOMINATION

A. LOCAL AUTHORITY ELECTION

1. In the case of a Political Party/Association/Organization. The submission of candidates shall be made on the prescribed FORM 22. Both Parts A and B shall be fully completed by Political Parties, Association or Organizations whereby:

1.1 Candidates should have reached the age of twenty-one (21) years of age in order to be elected to public office – Article 17 (2) Namibian Constitution;

1.2 A member of the political party/association/organization for which candidate is nominated., proof of membership or sworn declaration by authorized representative of political party/association/organization should accompany the application;

1.3 Candidate qualifying to be elected as a member should be in compliance of Article 47(1) (a) to (d) of the Namibian Constitution;

1.4 All listed candidates are registered voters for the local authority council concerned in terms of Section 7 (1) (a) of the Local Authorities Act where names shall be verified against local authority voters register.

1.5 Completion in full & abbreviation of Name of Political Party or Association/Organization, Local Authority Area should be maintained – (PART A);

1.6 A list containing the names, voter registration number, residential address, signature and sex of candidates – (PART A);
1.7 The list is numbering not less than the number of members required to fill the seats in the local authority council concerned (PART A) – appearing in the order as the political party/association/organization may determine. Accompanied by a list of five (5) names, registration numbers & residential addresses in addition thereto;

1.7.1 Party-list shall contain in terms of Section 6(4) (a) & (b) of the Local Authorities Act:

1.7.1.1 in the case of municipal/town/village council consisting of 10 or fewer members – the names of at least (3) female persons;
1.7.1.2 in the case of a municipal or town council consisting of 11 or more members – the names of at least five (5) female persons;
1.7.1.3 Certified copy of REGISTRATION CERTIFICATE of the registered political party or association/organization;
1.7.1.4 2 x (passport-sized) photos of the head of the registered political party or registered association/organization concerned, in form and colour as may be acceptable to the returning officer, but subject to any requirements laid down by the Commission. Passport photos should be in full colour and the name of the head of the political party/association/organization clearly marked on the back of the photo in such a manner that it does not reflect through on the face of the photo. Photos should be placed in a passport-sized envelope, clearly marked with the name of the political party/association/organization and the envelope should be stapled to the application form.

B. REGIONAL COUNCIL ELECTION

2. The submission of the nomination of candidates should be made in the prescribed FORM 21 whereby:

2.1 In the Case of a Political Party;
2.1.1 Parts A, B, D shall be fully completed by Political Parties
2.1.2 Candidates should have reached the age of twenty-one (21) years in order to be elected to public office (Article 17 (2) of the Namibian Constitution);
2.1.3 Is nominated as a member of a registered political party;
2.1.4 Candidate is registered as a voter for an election for members of Regional Council;
2.1.5 A person qualifies to be elected as a member of the National Council in terms of Article 72 read together with Article 47(1) (a) to (e) of the Namibian Constitution;
2.1.6 Is ordinary resident within the constituency for which he/she is elected, or if not resident at the time of the election, becomes an ordinary resident within a period of three months as from the date of election as a member of the Regional Council (Section 6 of the Regional Councils Act);
2.1.7. Person may not be nominated as a candidate in more than one constituency;
2.1.8 Completion of particulars of candidate – PART A;
2.1.9 Duly signed by the person who is the authorized representative of the political party or any office-bearer of the political party authorized thereto in writing by the authorized representative and stamped with the seal of the political party-PART B;
2.1.10 Candidate consents to the nomination – PART D;
2.2 2 x (passport sized) photos of the candidate, in form and colour as may be acceptable to the returning officer, but subject to any requirements laid down by the Commission. Passport photos should be in full colour and the name of the head of the political party/association/organization clearly marked on the back of the photo in such a manner that it does not reflect through on the face of the photo. Photos should be placed in a passport sized envelope, clearly marked with the name of the candidate and the envelope should be stapled to the application form.
2.2.1 An original RECEIPT indicating that an amount of N$2,500-00 has been deposited with the State Revenue Fund;
2.2.2 Certified copy of REGISTRATION CERTIFICATE of political party is attached;

2.3 In the case of an Independent Candidate;
2.3.1 Parts A, C, D and E are applicable;
2.3.2 Candidates should have reached the age of twenty-one years in order to be elected to public office (Article 17 (2) of the Namibian Constitution);
2.3.3 A person is nominated as an independent candidate whose nomination is supported by at least 150 registered voters in the constituency for which the nomination is intendedPART E;
2.3.4 Candidate is registered as a voter for an election for members of the Regional Councils;
2.3.5 A person qualifies to be elected as a member of the National Council in terms of Article 72 read together with Article 47(1) (a) to (e) of the Namibian Constitution;
2.3.6 Is ordinary resident within the constituency for which he/she is elected, or if not resident at the time of election, becomes an ordinary resident within a period of three months as from the date of election as a member of the Regional Council (Section 6 of the Regional Councils Act);
2.3.7 A person may not be nominated as a candidate in more than one constituency;
2.3.8 Completion of particulars of candidate – PART A;
2.3.9 PART C – Duly signed by any two persons whose name appear in the list of PART E of FORM 21.

2.3.10 Candidate consents to the nomination – PART D;
2.3.11 2 x (passport sized) photos of the candidate, in form and colour as may be acceptable to the returning officer, but subject to any requirements laid down by the Commission. Passport photos should be in full colour and the name of the head of the political party/association/organization clearly marked on the back of the photo in such a manner that it does not reflect through on the face of the photo. Photos should be placed in a passport size envelope and clearly marked with the name of the candidate and the envelope should be stapled to the application form.
2.3.12 An original RECEIPT indicating that an amount of N$2,500-00 has been deposited with the State Revenue Fund;

2.4 Submission of Nomination Forms may be submitted to Returning Officers for a constituency or local authority area at any time from 29th September 2020 between 08h00 – 17h00 weekdays at the venues indicated by Proclamation by H.E. the President. The last date for submission of nomination of candidates in the case of independent candidates is 14th October 2020 at 16h00. While the last date for submission of nomination in the case of political parties/associations/organizations is the 16th October 2020 at 11h00.

2.5 Political parties/organizations/associations and independent candidates are urged to collect and return the nomination forms well in advance in order to allow ample time for verification process.
